Terms of Service

1. Acceptance of Terms

By accessing or using the SIMS Plus platform ("Service"), operated by SIMS Plus Limited ("Company"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a school or organization, you represent that you have authority to bind that entity to these terms.

2. Description of Service

SIMS Plus is a multi-tenant, cloud-based school information management system that provides student management, academic management, financial management, staff management, communication tools, and analytics for educational institutions. Each school (tenant) accesses the platform via a unique subdomain (e.g., yourschool.simsplus.io).

3. Account Registration

  • You must provide accurate and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Each school receives a unique subdomain that must comply with our naming requirements (4–63 characters, lowercase alphanumeric and hyphens).
  • You must not share login credentials or allow unauthorized access to your school's account.

4. Free Trial

New schools are eligible for a 90-day free trial with full feature access for up to 100 students. At the end of the trial period, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify trial terms at any time.

5. Subscription & Payment

  • Subscription fees are billed monthly based on your selected plan (Starter, Professional, or Enterprise).
  • Payments may be made via Mobile Money (MTN, Vodafone Cash, AirtelTigo), bank transfer, or other methods we make available.
  • Failure to pay within 15 days of the due date may result in account suspension.
  • All fees are quoted in Ghana Cedis (GHS) unless otherwise stated.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access another school's data or another tenant's subdomain
  • Reverse-engineer, decompile, or tamper with the platform
  • Upload malicious software or content
  • Exceed API rate limits for your subscription tier
  • Resell or redistribute access to the platform without authorization

7. Data Ownership

You retain full ownership of all data entered into the platform by your school. SIMS Plus does not claim ownership of your school's data. You grant us a limited license to process, store, and transmit your data solely for the purpose of providing the Service. You may request a full export of your data at any time.

8. Service Availability

We target 99.5% platform uptime. Planned maintenance will be scheduled outside school hours where possible. We are not liable for downtime caused by factors beyond our control, including internet service provider failures, power outages, or force majeure events.

9. Termination

  • You may cancel your subscription at any time.
  • Upon cancellation, your data will be preserved for 90 days before permanent deletion.
  • We may suspend or terminate accounts that violate these terms.
  • Suspended accounts will see a suspension notice and will not be able to access the platform.

10. Limitation of Liability

To the maximum extent permitted by Ghanaian law, SIMS Plus shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Service. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes shall be resolved in the courts of Ghana.
